Explain first, recruit second
Get the order right — this is where many employers work backwards.
Before recruiting a foreign worker, the employer must determine the need and file an explanatory report with the competent authority. The report covers the position, headcount, qualifications, experience, salary and working period.
Many employers do this backwards: they recruit first, then discover while assembling the permit file that no demand explanation was ever filed. At that point they must go back and file it and wait for approval, while the employee has already arrived in Vietnam and cannot work lawfully.
The explanatory report must be filed at least 15 days before the intended start of employment.
Changes against a filed report
If the position, headcount or any reported detail changes, a fresh report must be filed at least 15 days before the intended start date. An approval issued for one position cannot be used for another.
